{"id":9991,"date":"2020-10-30T12:39:54","date_gmt":"2020-10-30T11:39:54","guid":{"rendered":"https:\/\/www.sikuel.it\/?p=9991"},"modified":"2021-07-06T14:44:28","modified_gmt":"2021-07-06T12:44:28","slug":"waste-management-service-data-transparency","status":"publish","type":"post","link":"https:\/\/www.sikuel.it\/en\/gestione-rifiuti\/trasparenza-dati-servizio-gestione-rifiuti\/","title":{"rendered":"Transparency of Waste Management Integrated Service Data \u2013 ARERA 444\/2019"},"content":{"rendered":"<div class=\"page\" title=\"Page 1\">\n<div class=\"layoutArea\">\n<div class=\"column\">\nArera \u2013 Resolution 444\/2019\/R\/rif, updated with the provisions contained in Resolution 59\/2020\/R\/com<br \/>\n<strong>Provisions for the Transparency of Urban and Similar Integrated Waste Management Service Data<br \/>\n<\/strong><em>Approval of the Integrated Text on Transparency in Waste Management Services for the period 1st July 2020 \u2013 31st December 2023.<br \/>\nInitiatives aimed at strengthening consumer awareness and data transparency for better service evaluation<\/em><br \/>\n<em>\u00a0<\/em><br \/>\nWith Resolution 444\/2019 and the TITR, the Authority has identified the <strong>\u201cminimum information elements\u201d<\/strong> which must be guaranteed to all users of the Integrated Urban Waste Service, meaning all domestic and non-domestic users liable for TARI payment.<br \/>\nThe new obligations shall apply from 1 July to 31 December 2023 (Art. 2) to all service providers. <em>(those providing services covered by <a href=\"https:\/\/www.sikuel.it\/en\/2020\/01\/31\/pef-tariff-2020-arera\/\" target=\"_blank\" rel=\"noopener\"><span style=\"color: #ff6600;\"><strong>Financial and Economic Plan<\/strong><\/span><\/a>),<\/em> including Municipalities that manage the service in-house, in whole or in part.<br \/>\nAlthough experimentally for the whole of 2020, the actual start time varies according to the demographic size of the Municipalities.<\/p>\n<ol>\n<li><strong>Application from 1st July 2020<\/strong> \u2013 For all integrated service managers operating in territories with a resident population exceeding 5,000 inhabitants<\/li>\n<li><strong>Application from 1 January 2021<\/strong> \u2013 Integrated service managers or managers of individual collection and transport and\/or street sweeping and washing services, including municipalities, operating in territories with a resident population not exceeding 5000 inhabitants<\/li>\n<li><strong>Application from 1 January 2021 \u2013 <\/strong>Managers of tariff management activities and user relations, including Municipalities, operating in territories with a resident population not exceeding 5000 inhabitants<\/li>\n<\/ol>\n<p>&nbsp;<br \/>\nThe tools to reach users will be the <strong>Integrated waste service manager's website<\/strong> and <strong>collection documents<\/strong> (Payment notice, invoice).<br \/>\nCommunications defined as \u201csignificant\u201d must be sent at least 30 days in advance to the affected users, including on an individual basis.<br \/>\nFrom an operational perspective (Art. 3), managers are required to <strong>to prepare and keep up-to-date a dedicated section of its website, easily accessible from the home page<\/strong>, which presents at least the following informational content, organised in a way that facilitates clear identification by users:<\/p>\n<ul>\n<li>Company name of the operator providing the integrated urban waste management service, or the operator carrying out tariff management and user relations activities, the waste collection and transport operator, and the street sweeping and washing operator, should these activities be carried out by separate entities;<\/li>\n<li>telephone, postal and email contact details for sending information requests, service malfunction reports and complaints, as well as, where available, contact details and opening hours of physical service points for user assistance;<\/li>\n<li>forms for submitting complaints, freely accessible and downloadable;<\/li>\n<li>current calendar and times regarding the collection of urban waste, with reference to all collection methods available to the user, including collection centres, but excluding any collection methods for which programming is not possible; \u2013 7 \u2013<\/li>\n<li>Information regarding any extraordinary urban waste collection campaigns and new openings or closures of collection centres.;<\/li>\n<li>Instructions for the correct disposal of urban waste for collection and transport services;<\/li>\n<li>Current Service Quality Charter, freely downloadable;<\/li>\n<li>the separate waste collection percentage achieved in the Municipality or territorial area where the user is located, with reference to the three calendar years preceding the current one, calculated as indicated in Article 10, paragraphs 10.1 and 10.2;<\/li>\n<li>schedule and times for street sweeping and washing services, or, where the service is not programmed, the frequency of the service, and, in any case, any prohibitions relating to traffic and parking;<\/li>\n<li>Calculation rules for the tariff, with user-friendly indications, including examples, of the variables on which the calculation of the fixed and variable charges is based, of the reductions applicable to domestic and non-domestic users, of the adjustment mechanisms, and of the applicable taxes;<\/li>\n<li>Information on access to any tariff reductions granted to users experiencing economic and social hardship, and the relevant procedure, where the above-mentioned reductions are foreseen.;<\/li>\n<li>details of the tariff approval acts for the current year with reference to the area or municipalities served;<\/li>\n<li>TARI regulations or regulations for the application of a compensatory fee issued pursuant to Article 1, paragraph 668, of Law no. 147\/13;<\/li>\n<li>Accepted payment methods, with explicit details of any free payment methods;<\/li>\n<li>deadlines for payment of the fee for the current year;<\/li>\n<li>relevant information regarding late or non-payment, including, where applicable, the indication of the default interest rate and\/or penalties and\/or sanctions, as well as all useful information to enable the user to promptly make payment of the amount due;<\/li>\n<li>procedures for reporting errors in the determination of invoiced amounts, and errors and\/or variations in user data or user characteristics relevant for tariff calculation, with related forms, including forms for refund requests, freely accessible and downloadable; \u2013 8 \u2013<\/li>\n<li>information on the possibility of receiving collection documents in electronic format and the related activation procedure;<\/li>\n<li>any communications to users by the Authority concerning significant changes to the regulatory framework or other general communications intended for users; in such cases, the text of the communication shall be made known to the operator via the Authority's website and must be published on the website of the parties referred to in paragraph 2.2 above within 30 (thirty) calendar days of its publication on the Authority's website.<\/li>\n<\/ul>\n<p>&nbsp;<br \/>\n&nbsp;<br \/>\nThe elements to be provided instead via the collection documents and therefore through <strong><span style=\"color: #ff6600;\">The new Waste Bill<\/span>, <\/strong>They must clearly and comprehensibly report general information on the amounts charged, payment methods, and the environmental services and results achieved.<br \/>\n<span style=\"color: #ff6600;\"><strong>The Document must also contain specific instructions allowing users to opt for its electronic receipt, with the relevant activation procedure. (Art. 4)<\/strong><\/span><br \/>\n<span style=\"color: #ff6600;\"><strong><em><u>General information in collection documents (Art. 5)<\/u><\/em><\/strong><\/span><\/p>\n<ol>\n<li>indication of the service to which the charged amount relates;<\/li>\n<li>user identification data, including surname, first name, and fiscal code or company name and VAT number, as well as the unique user identification code;<\/li>\n<li>characteristics data of each of the supply points to which the debited amount refers, where the same are necessary for the purpose of determining the tariff:\n<ul>\n<li>Address and user code;<\/li>\n<li>chargeable surface area, expressed in square metres;<\/li>\n<li>cadastral data, where available;<\/li>\n<li>User category;<\/li>\n<li>in the case of domestic use, number of occupants of the property;<\/li>\n<li>where the charge is commensurate with the quantity of waste delivered to the public waste collection service, indication of such quantities, with reference to the fraction(s) subject to measurement for the purpose of determining the charge;<\/li>\n<\/ul>\n<\/li>\n<li>internet address and\/or telephone number and\/or physical branch address where the procedure for communicating any errors or variations in the data referred to in points b) and c) of this paragraph can be found;<\/li>\n<li>reference period of the collection document; in the event of variations during the year of the data referred to in letter c) of this paragraph, the date of commencement of such variations shall be indicated, highlighting the amounts due for the provision of the service.;<\/li>\n<li>telephone, postal, and email contact details for sending requests for information, complaints, and\/or requests for correction concerning the amount charged and payment, as well as, where available, contact details and opening hours of physical branches for user assistance.<\/li>\n<\/ol>\n<p>&nbsp;<br \/>\n&nbsp;<br \/>\n<span style=\"color: #ff6600;\"><strong><em><u>Information on amounts charged in collection documents (Art. 6)<\/u><\/em><\/strong><\/span><\/p>\n<ol>\n<li>Total amount charged, with reference to each individual user, where applicable, for the integrated urban waste management service, or for the collection and transport activity and the street sweeping and washing activity, where these services are billed separately, expressed in euros; in the event of variations during the year in the data referred to in paragraph 5.1, letter c), from point ii) to point v), the collection document shall clearly indicate the amounts relating to each user situation in the reference period of the collection document;<\/li>\n<li>deadline for lump-sum payment;<\/li>\n<li>where applicable, the amount, expressed in euros, of each instalment in which payment may be made pursuant to Article 1, paragraph 688, of Law no. 147\/13, with the relevant due date;<\/li>\n<li>a clear indication of the amounts, expressed in euros, relating to the fixed and variable parts of the tariff;<\/li>\n<li>in the case of applying a tariff with metered quantities of waste deposited, an indication, where relevant, of the services included in the minimum service;<\/li>\n<li>amount, in euros, and brief description of any discounts applied;<\/li>\n<li>amount, expressed in euros, of any adjustments relating to previous periods and indication of the possibility that the amount charged with reference to the current period may be adjusted as a settlement;<\/li>\n<li>a separate breakdown of the amounts, expressed in Euros, relating to taxes, duties or surcharges, as well as any additional tariff components other than those due for the integrated urban waste management service, in accordance with current legislation;<\/li>\n<li>details of the relevant approval acts with reference to the applied tariff or, in the case of adjustments, to the applied tariffs;<\/li>\n<li>Details of the website and\/or telephone numbers and\/or physical branch addresses, where available, where information can be obtained for access to any tariff reductions granted to users in a state of economic and social hardship, and the relevant procedure, where the aforementioned reductions are foreseen.<\/li>\n<\/ol>\n<p>&nbsp;<br \/>\n<span style=\"color: #ff6600;\"><strong><em><u>Information on payment methods for collection documents (Art. 7)<\/u><\/em><\/strong><\/span><\/p>\n<ol>\n<li>list of accepted payment methods, including details of all beneficiary information necessary for the user to make the payment;<\/li>\n<li>details of previous payments, where available, including any amounts still outstanding and their due dates;<\/li>\n<li>where amounts are still due, the procedures that apply in case of late or omitted payment, as well as information on any applicable default interest rates and\/or penalties and\/or sanctions, as well as all useful instructions so that the user is in a position to promptly proceed with the payment of the amount due.<\/li>\n<\/ol>\n<p>&nbsp;<br \/>\n<span style=\"color: #ff6600;\"><strong><em><u>Information on service and environmental results in recovery documents<\/u><\/em><\/strong><\/span><\/p>\n<ol>\n<li>Company name of the operator providing the integrated municipal waste management service, i.e. the collection and transport service and\/or the street sweeping and washing service operator;<\/li>\n<li>telephone, postal and email contact details for sending information requests, reporting service disruptions and submitting complaints by users, with reference to the collection and transport service and the street sweeping and washing service;<\/li>\n<li>Contact details and opening hours for physical branches (where available) for user assistance;<\/li>\n<li>Indication of the website where the Service Quality Charter and the other information referred to in Article 3 are available.<\/li>\n<\/ol>\n<p>The collection document or any annexes attached to it show the following minimum information at least annually:<\/p>\n<ol>\n<li>The current calendar and times for the collection of urban waste, with reference to all collection methods available to the user, including recycling centres, and excluding any collection methods for which programming is not possible; alternatively, an indication of the website of the service provider or the company responsible for collection and transport where this information is available.;<\/li>\n<li>calendar and times for street sweeping and washing activities, and where these are not scheduled, information on their frequency, as well as any prohibitions relating to traffic and parking connected with street sweeping and washing activities;
