From 1 January 2020, the new TWO-YEAR STATUTE OF LIMITATIONS will apply to invoices and unbilled water consumption, in compliance with the 2018 Budget Law.
This means that, if the Water Services Manager They have not yet issued invoices for consumption in 2017, or even previous years. From 1 January 2020, the customer will be able to object to the statute of limitations on cubic metres consumed up to 31 December 2017 and only pay for consumption relating to periods after that date. The statute of limitations will also apply to any adjustments relating to 2017 or previous years.
ARERA Authority Resolutions already impose a fairly frequent reading and subsequent billing periodicity for consumption, at least twice a year (but it depends on the average consumption of the user, it can reach 4 or 6 bills a year).
Failing to issue invoices for actual consumption (not just estimated advance payments, but also final balance invoices) more than two years later not only constitutes a violation of contractual service quality but, from 2020, will be an undue demand for charges invoiced late, directly attributable to the supplier.
Therefore, it is recommended to verify that all years prior to 2018 have already been invoiced (and SETTLED) by 31/12/2019, as in this case the invoices and invoiced consumption will follow the normal 5-year statute of limitations.
