ARERA – COVID-19 Emergency: Resolution 59 and Resolution 60 of 12 March 2020

Following the Prime Ministerial Decree of 9 March 2020, strengthened measures to combat and contain the spread of the COVID-19 virus, ARERA intervened with Resolutions 59 and 60 of 12 March 2020:

  • With the blocking of all possible procedures for suspending electricity, gas, and water supplies for ARREARS by households and small businesses. In practice, for Water Services, in the case of arrears, given the ongoing emergency, the operator must NOT proceed with the limitation/suspension/disconnection of all types of domestic and non-domestic utilities, from March 10th last up to April 3rd, 2020. If the operator has already carried out a suspension, they must promptly reactivate the suspended supply. (Del. 60/2020/R/COM)
    Extended until April 13th, in line with the latest government decree (DPCM 1 April 2020).
  • A CURRENT ACCOUNT is also established with the Cassa per i servizi energetici e ambientali (Energy and Environmental Services Fund), with a limit of €1 billion, to ensure the sustainability of current and future regulatory interventions in favour of consumers and users.   • Finally, the deadlines for short-term compliance for environmental and energy services are deferred (Resolution 59/2020/R/COM) and in particular:

 

Postponement of deadlines for integrated water services

The deadline for communicating to the Authority for information and data regarding CONTRACTUAL QUALITY for the year 2019 (paragraph 77.1 of Annex A to resolution 655/2015/R/IDR and to the Communication of 18 February 2020) is deferred:

      • a) for managers, from 16 March 2020 to 15 May 2020;
      • b) for the territorial government bodies, from 27 April 2020 to 26 June 2020.

The terms for data collection for the assessment of achieving the TECHNICAL QUALITY objectives of the water service for the years 2018 and 2019 (referred to in point 2 of resolution 46/2020/R/IDR) have been postponed.

      • a) from 17 April 2020 to 17 June 2020, the peremptory term for managers;
      • b) from 30 September 2020 to 31 October 2020, the deadline for the allocation of the relevant bonuses and penalties provided for by the quality incentive mechanism for integrated water services referred to in Title 7 of Annex A to resolution 917/2017/R/IDR.

The deadline (originally set for 30 April 2020) referred to in paragraph 5.3 of resolution 580/2019/R/IDR, by which the competent authority for the area, or another competent body, is required to transmit, for approval by the Authority, the relevant REGULATORY FRAMEWORK containing the TARIFF STRUCTURE for the third regulatory period 2020-2023 in compliance with MTI-3, is therefore extended to 30 June 2020.

 

Postponement of the deadlines for the waste management service, including separate collection, urban and assimilated waste

  • It is postponed from 1 April 2020 to 1 July 2020 the deadline referred to in paragraph 2.3, letter. a), of Annex A to resolution 444/2019/R/RIF (TITR), from which the provisions regarding the minimum information elements that must be guaranteed to the user of the integrated urban waste management service apply.
  • Consequently, the deadline referred to in paragraph 11.1, letter [insert letter here], is postponed from 30 April 2020 to 31 July 2020. a) of Annex A to resolution 444/2019/R/RIF within which the managers of collection and transport activities and the managers of street sweeping and washing activities are required to transmit to the manager of the tariff management and user relations activity the relevant information referred to in paragraphs 3.1, 5.1, 6.1, 7.1, 8.1 and 8.2 of the TITR.
